Example of Our Dog Sales Agreement
We required a contract to be signed by both the breeder and the new owner prior to the Border Collie going to his or her new home. The buyer must be at least 18 years of age.
This Agreement made this _____day of______________, 20___ by and between Tiffany (First Party/breeder) and Name of the New Owner (Second Party/buyer).
Witnesseth: That in consideration of the mutual covenants and agreements to be kept and performed on the part of said parties hereto, respectively as herein stated:
I. The Breeder agrees to: Sell the buyer a (male/female) (color) border collie puppy born (DOB) for the amount of $500.00 dollars with a spay/neuter agreement, which means the buyer is to have the dog spayed/ neutered by a licensed vet prior to the age of seven months of age. The breeder will not be responsible or pay for any shipping expenses. The breeder will give the buyer a receipt for any payments made toward the cost of the puppy. The breeder will take back the dog listed above and give the buyer a full refund of the purchase price, or provide the buyer with a new dog of equal value when one becomes available, if the said dog is found to have hip dysplasia (HD) or any other serious genetic health problem prior to his or her first birthday, but the breeder will not pay for any shipping expenses, and proof of the dog having HD, or other genetic problem from the vet that made the diagnosis must be given to the breeder, and the dog must be given back to the breeder prior to giving the buyer the refund.
The breeder will register the mentioned dog with the American Border Collie Association as a non-breeding dog, and will withhold the dog's pedigree until suitable proof, (such as the vet invoice or the spay/neuter certificate) of having the dog spayed/neutered by a licensed vet is received along with the vet's contact information. The breeder can choose not to give the buyer the puppy's pedigree if the breeder has not received the proof of the dog being spayed/neutered by a licensed vet prior to the puppy turning seven months of age.
The breeder also agrees that the puppy was examined by a licensed vet and was found to be healthy prior to selling the puppy to the buyer. Also the breeder agrees that the puppy was wormed and given vaccinations appropriate for the age of the puppy while in the breeder's care, and that the puppy should never develop CEA. The breeder will take back the puppy listed above and give a full refund of the purchase price if the puppy is found to be unhealthy within two weeks of the purchase date listed above, but the breeder will not be held responsible for shipping expenses, vet fees occurred, and documentation from a licensed vet along with the puppy's diagnosis must be received prior to taking the dog back; However, the breeder will not be held responsible for an unhealthy, dead, or injured puppy resulting from acts of the buyer or another person such as abuse, neglect, getting ran over, eating poison or being poisoned in any way, being killed or injured, etc.
The breeder will take back the dog and give the buyer a full refund of the purchase price within two weeks of the purchase date if the buyer is not satisfied with the puppy, but the buyer is to pay for the shipping if it is needed, and the puppy must be returned in the same condition in which the puppy was received by the buyer before the refund is given. The breeder will take back the dog for any reason if the buyer is unable to care for it, but will not give the buyer a refund or pay for the dog, and the buyer of the dog will pay for shipping expenses if needed.
II. The Buyer agrees to: The buyer agrees to pay the breeder the amount of five-hundred dollars ($500.00) for the puppy mentioned above with the mentioned spay/neuter agreement, and pay for the shipping expenses of the puppy if needed. The buyer agrees to care for the puppy as a dog should be taken care of, which includes and is not limited to taking him/her to the vet at least once a year for an examination and for a rabies vaccination, give him/her heartworm preventatives to prevent heartworms, worm him/her as is required, feed him/her daily, provide him/her with clean water, give him/her suitable shelter in all weather conditions. The buyer agrees that he/she will give him the dog back to the breeder for no cost to the breeder, if found to abuse or neglect the dog.
The buyer agrees to have the puppy spayed or neutered prior by a licensed vet prior to the age of seven months of age and provide the breeder with proof of the operation in a timely manner. The buyer also agrees to contact the breeder prior to the reselling (or placement) of the dog.
The buyer agrees that he/she will never surrender the dog to a humane society or breed rescue, and will instead of surrendering the dog to a humane society, or breed rescue, return the dog to the breeder.
Both parties agree that:
Both parties agree that they were over the age of 18 years, and fully understood this Agreement/Contract when they signed it. If the buyer wants to compete in AKC events with the dog by means of the American Kennel Club Purebred Alternative Listing (PAL/ILP), he or she may do so.
This agreement shall be binding upon the parties, their successors, assigns and personal representatives. Time is of the essence on all undertakings. This agreement shall be enforced under the laws of the state of Mississippi.
The entire agreement is typed, and any handwriting, other than the signatures is not part of the agreement.
